In particular, the security of your personal information provided in relation to the CM Photo Center Service, at cmphotocenter.com (the “site”), is of great concern to Creative Memories. Services
Creative Memories is committed to providing you with a secure environment to store, share and print your digital images. To use the CM Photo Center Service you must create a password-protected account that you will have sole control over. Hence, you can individually manage who will be provided access to the images stored in your CM Photo Center account.
Personal Information
Creative Memories only uses your personal information to assist in providing the CM Photo Center Service to you. Your personally identifiable information will not be rented, sold or shared with any third party, except as provided to third party intermediaries who help us run the CM Photo Center Service and Web site. Your personal information is only provided to third parties, such as credit card authorization companies, photo processing labs, merchandise distributors, vendors processing our outbound email communication, etc., for the purpose of providing you the CM Photo Center Services requested at the time you request them. Third parties do not store, retain, access or otherwise use your personal information other than to provide you with the requested CM Photo Center Service, and they are held to confidentiality agreements with Creative Memories.
Creative Memories reserves the right to change this Privacy Policy at its sole discretion. If there is a need to change the Privacy Policy, we will email our CM Photo Center account holders announcing the new Privacy Policy, and if applicable, provide users with a way to opt out of any changes to the way their personal information will be used.
Please note that you should review the Terms & Conditions that govern your use of the CM Photo Center Service, as the Privacy Policy is considered part of the Terms & Conditions.
Information Collected
Information Explicitly Provided
In order to establish a CM Photo Center account, you will need to provide personal information when you create an account (personally identifiable information):
- first and last name
- email address
- personal password (to secure access to your account)
When you order prints you will need to provide more information:
- mailing address
- billing name and address
- credit card number and expiration date
Creative Memories only uses your credit card information to process your order and will not share this information with any third party, except as provided by necessity to third party intermediaries who are integral in processing your order.
If you wish to share your digital images with others, you need to provide email addresses for distribution. Creative Memories will email the guests you have specified and invite them to view your images at CM Photo Center. If your guests are not currently CM Photo Center members they must create a CM Photo Center account and accept the Terms & Conditions of the CM Photo Center before viewing your images. Your guests’ email addresses will only be used to facilitate in sharing your images with them.
Your CM Photo Center account will include an online address book where you can store mailing addresses and email addresses of family and friends. This online address book is private and accessible only by you through your password. Creative Memories will not use any information contained in your private online address book for any non-service or support related purpose.
Creative Memories may use non-identifying and aggregate information for the purpose of enhancing the CM Photo Center Service and to share with business partners. For example, Creative Memories may tell a partner that X number of individuals visited a certain area on the site, or that Y number of men and Z number of women filled out a registration form, but Creative Memories would not disclose anything that could be used to identify those individuals.
Information Automatically Collected (electronic)
Cookies and Pixel Tags – Creative Memories uses cookies and pixel tags to track users of CM Photo Center Services. Cookies are pieces of information stored on a user's computer by a Web site so preferences are remembered on future requests. Pixel tags (also know as “Web Bugs,” “Web Beacons,” “Clear Gifs,” “Invisible Gifs,” and “Tracker Gifs”) are signals sent from certain Web sites or emails used to pass certain information to our servers to personalize our Web sites and to track your usage. Creative Memories does not save password or credit card number information on cookies or through use of pixel tags. Rather, cookies and pixel tags are used to optimize the performance and functionality of the site, and to personalize the site for you and present you with content and offers specific to your interests.
If you are uncomfortable with the idea of your information being stored in cookies, Creative Memories recommends disabling cookie support in your browser. However, please note that this may limit the performance and functionality of the CM Photo Center site.
IP Address - When you visit the site to read or download information, Creative Memories collects and stores only the following: the name of the domain from which you access the Internet (for example, aol.com, if you are connecting from an America Online account), the date and time you access the site, and the Internet address of the Web site from which you linked directly to the site. Creative Memories uses this information to measure the number of visitors to the different sections of the site and to help us make the site more useful to visitors.
Security
All digital images are uploaded over a secure internet connection to a highly secure Data Center. The images are continually backed-up on two separate servers in different locations within the Data Center and also in one protected offsite facility.
Creative Memories is committed to the security of your personal information. Creative Memories uses industry best practices to protect the privacy of your personally identifiable information. When providing sensitive information, such as your password or credit card information, Creative Memories encrypts this information through SSL, an encryption and security technology.
Creative Memories values the intellectual property rights of others. Creative Memories claims no ownership interest in your digital images stored in the CM Photo Center. We are committed to keeping your images private and secure. Through your password-protected CM Photo Center account you have sole control over directing the access others have to your images. Please note that by sharing your images, you allow recipients to share and make photographic prints from the images you provided access to.
Miscellaneous
Please note that if based on good faith belief that the law requires it, or to protect your or Creative Memories’ rights or property, Creative Memories will disclose your personal information to the extent required.
If, when you register for the CM Photo Center Service, you agree to let Creative Memories send promotional information to you, Creative Memories will use your personal information to send you promotions and other information regarding its products and services. If you choose to opt out you can easily uncheck the e-mail notification box located under the account information link on the site.
At any time you can change or update any of your personal information under the account information link on the site.
Creative Memories will never ask for member name and password information unless you initiate the conversation and that information is relevant in assisting you.
